Aside from the legal inconsistencies of war on a philosophy (terrorism) or an amorphous group of people vs. nation against nation in armed conflict (war) the idea of a global war on terror is a meaningless term. We need to rethink the problem and its solutions. If we consider terrorist in the vein of pirates of the old days, the law makes sense. Every nation had an obligation to pursue and capture pirates whereever they were found. They were tried in criminal courts, or admiralty courts. They were punished and imprisoned where tried. The advantage is that no nation need send their youth to a far land to fight, kill both enemy and innocent, and die when established local and international police forces could do the job. And, no nation would be able to use the excuse of preemptive war. It would save lives and money. It would not create nations of innocent people that resent another invading country. Additionally it would be easier to send humanitarian aid to areas that need it. That would lessen the ability of terrorists to recruit men, and it would hopefully lessen torture in the world.
